Please read these Terms of Service carefully. They form a binding legal agreement between you and Captomi LLC and govern your access to and use of the captomi.com website.

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the captomi.com website and its content (the "Site"), which is operated by Captomi LLC ("Captomi," "we," "our," or "us").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Site.

The Site is intended for businesses and for individuals who are at least 18 years old and able to form a legally binding contract. If you use the Site on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. About Captomi and This Website

Captomi is a software company headquartered in the United States. We design, build, and ship AI-powered software for businesses, combining frontier AI models, domain expertise, and a focus on usability.

The Site is an informational and marketing website. It provides information about Captomi and its offerings and a way to get in touch with us. The Site itself does not provide user accounts, paid subscriptions, or product functionality.

Captomi's software products, demos, and trial environments are provided under separate terms — such as product-specific terms, or a signed master agreement, order form, or statement of work. Those offerings are not governed by these Terms, which apply only to the Site.

3. Acceptable Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to, and not to permit any third party to:

We may investigate suspected violations and may restrict or terminate access to the Site for conduct that we reasonably believe violates these Terms or creates risk or legal exposure for Captomi or others.

4. Information You Submit and Communications

You may choose to contact us through the Site or through the email addresses and phone number we provide — for example, to ask about our offerings. You are responsible for ensuring that the information you send us is accurate and that you have the right to share it.

How we handle personal information you provide is described in our Privacy Policy, which is incorporated into these Terms by reference.

When you contact us, you agree that we may respond and communicate with you regarding your inquiry. Captomi operates a consumer-initiated text messaging service: when you text or call the business first, an automated assistant may reply by SMS to answer your questions and help you schedule appointments, and we may send related confirmations and reminders. Your own message or call is your consent to receive these replies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help. The full terms that govern this messaging service are set out in our SMS Terms of Service, and how we handle related personal information is described in our Privacy Policy.

5. Intellectual Property

The Site and its content — including text, graphics, logos, images, layouts, and design — and all related intellectual property rights are owned by Captomi or its licensors and are protected by applicable laws.

Subject to your compliance with these Terms, you may view and use the Site for your own informational purposes and to evaluate Captomi's offerings for your business. You may not copy, reproduce, republish, distribute, or create derivative works from the Site or its content without our prior written consent.

The Captomi name, logo, and brand are trademarks of Captomi. These Terms do not grant you any right to use them without our prior written consent.

If you provide feedback or suggestions about the Site, you grant Captomi a perpetual, irrevocable, royalty-free license to use them without restriction or obligation to you.

6. Third-Party Links and Services

The Site may contain links to, or rely on, third-party websites and services that Captomi does not control. We provide these for convenience and are not responsible for the content, products, or practices of any third party. Your use of any third-party website or service is at your own risk and subject to that third party's own terms and privacy practices.

7. Disclaimers

Information on the Site is provided for general informational purposes only and does not constitute legal, financial, or other professional advice.

8. Limitation of Liability

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Captomi and its officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site in violation of these Terms or applicable law, or your violation of any third-party right.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The state and federal courts located in Sacramento County, California will have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Site, and you consent to personal jurisdiction and venue there.

To the extent permitted by law, any claim arising out of or related to the Site must be brought within one year after it arises.

11. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date above. Your continued use of the Site after the updated Terms take effect constitutes acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Site.

12. Miscellaneous

These Terms are the entire agreement between you and Captomi regarding the Site and supersede all prior or contemporaneous understandings on that subject. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without Captomi's prior written consent; Captomi may assign these Terms in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between the parties.
